TONYKWANG (hereinafter referred to as “we,” “us,” or “our”), the operator of TONYKWANG, respects your privacy and values our relationship with you.

When you visit a store (the “Store”) that we are authorized to establish through our SaaS service provider SHOPLINE (“SHOPLINE”), we may collect and process personal data relating to you (including your employees/representatives or any individuals acting on your behalf). If you browse or make purchases on the Store, we may also collect and process your personal data.

We understand the importance of personal data and are committed to maintaining the integrity and security of the Store. This Privacy Policy describes:

  • the types of personal data we collect,

  • how we use that information,

  • with whom we share it, and

  • the choices available to you regarding our use of your information.

This Privacy Policy will help you understand the following:


1. What We Collect

We may obtain personal data about you from various sources. We may collect this information when you use our Store, or when you access and/or use our social media/social networking pages (or related shops or corresponding applications), such as Facebook and Instagram.

Our products are available at department stores and other physical retail locations. If you are a registered member of our Store, we may also collect records related to your purchases made at physical retail locations.

When you visit the Store or our social media/social networking pages (or related shops or corresponding applications), we may also automatically collect certain information about your device or usage through cookies, web server logs, web beacons, and similar technologies.

Where you have provided data and expressly consented, we may use the categories of personal data described in the “Information You Provide” section for direct marketing.

Direct marketing communications may be delivered through various channels, including phone calls, mail, email, SMS, mobile applications, web applications, social commerce stores, and other methods.

If you do not want us to use your personal data for direct marketing, you may opt out by following the procedures described in the “Your Rights and Choices” section below. Upon request, we will stop using your personal data for direct marketing without charging you any fees.

We will use personal data for direct marketing only in accordance with the Personal Data Protection Act of the Republic of China (Taiwan). Our direct marketing may include, without limitation, marketing mail, email, and SMS, as described below.


9. How We Use Cookies and Similar Tracking Technologies

(1) What are “Cookies”?

Cookies are small files stored on your computer, mobile phone, or other smart device when you log in to or browse the Store. Cookies usually contain identifiers, store name, and certain numbers/characters. When you revisit the Store, the Store may recognize your browser via cookies. 10. How We Process, Use, Share, Transfer, and Disclose Personal Data

(1) Processing and Use

Some Store functions may be provided by third-party partners. We may engage partners (including technology service providers) to process certain personal data—for example, payment processors handling your card information to complete transactions; or service providers that facilitate “Know Your Customer” procedures, transaction monitoring, and risk management when using SHOPLINE payments.

We will enter into confidentiality agreements with such providers and define the purposes, duration, and responsibilities of data processing. We will require partners to process data in accordance with our requirements and this Privacy Policy. If you do not agree to such collection, you or your customers may not be able to use certain services.

(2) Sharing

We do not share personal data with third parties unless one or more of the following applies:

  • As required by you, or with your prior explicit authorization/consent

  • To fulfill legal obligations

  • Directly related to national security or defense

  • Directly related to public safety, public health, or major public interest

  • Directly related to criminal investigation, prosecution, trial, or enforcement

Sharing with SHOPLINE and its affiliates:
To provide SHOPLINE products and services, offer recommendations, resolve account issues, and protect safety, you acknowledge and agree that we may share personal data of you and your customers with our affiliates. We will share only what is necessary and for the purposes stated in this Privacy Policy. If sensitive personal data is involved, or if affiliates use the data for different purposes, we will seek authorization/consent again.

Sharing with third-party partners:
We share personal data only for lawful, legitimate, necessary, specific, and explicit purposes, and only to the extent required to provide relevant services. Unless otherwise required by laws/regulations, we do not share personal data that can directly identify you. Many partners may be independent data controllers and may have their own privacy policies and user agreements.

Additionally, the Store may use third-party features or services (including Apps Store apps, payment gateways, or logistics provider apps). These third-party services are not governed by this Privacy Policy, and any information you provide to them is provided directly to their operators. You must comply with their privacy policies/user agreements (if any). We are not responsible for third-party content or their privacy/security practices. Please review third-party policies before providing personal data.

(3) Transfer

In principle, we do not transfer control of personal data to any third party, except:

  • At the request of the data subject, or with your prior explicit authorization/consent

  • To fulfill legal obligations

  • Directly related to national security/defense, public safety/health, major public interest, criminal investigation/prosecution/trial/enforcement

  • To protect vital legitimate interests where consent is difficult to obtain

  • Data disclosed by you to the public

  • Data collected from legally/publicly available sources

  • Transfers due to changes in business entity after acquisition, merger, reorganization, or bankruptcy

If transfer is necessary, we will inform you of the purpose, type of data, and transferee (and notify you if sensitive information is involved), and obtain your consent unless laws/regulations provide otherwise. The transferee must continue to fulfill personal data obligations under this agreement.

If we declare bankruptcy or cease operations and there is no transferee, we will delete or anonymize your personal data.

(4) Public Disclosure

In principle, we do not disclose your personal data to the public or undefined groups, unless required under our agreement with you or applicable laws/regulations.

(5) Minors

This Store is not intended for individuals under the age of 18. We do not knowingly collect personal data from children. If you are a parent/guardian and believe your child has provided personal data to us, please contact us to request deletion.


11. Your Rights and Choices

We provide you with certain choices regarding the personal data we collect, such as how we use it and how we communicate with you. To update preferences, request removal from our mailing list, or submit a request, please contact us as described below.


12. Email Opt-Out Statement

13. Social Media App Opt-Out Statement

To remove or delete our social media applications from your social network account, please follow the instructions provided by the social network platform. For Facebook, please refer to Facebook Help Center instructions.


14. Geolocation Information

When using our mobile application, you may be asked to provide your geolocation through the app. You may choose not to share detailed geolocation data by adjusting location services settings on your mobile device.


15. Withdrawal of Consent

You may withdraw any consent you previously provided or object to the processing of your personal data at any time on lawful grounds. We will apply your preferences going forward. In some cases, withdrawing consent may mean you cannot access certain products or services.


16. Access, Update, and Correction of Personal Data

We may retain and use your information as needed to fulfill the purposes described above. You have the right to request access to, receive details of, update, correct inaccuracies in, and, where applicable, restrict or delete your personal data. In certain cases, local laws may limit access rights. Before granting access or making corrections, we may take reasonable steps to verify your identity.

However, no system is completely secure. We cannot guarantee the security of your information under all circumstances, including during transmission to us or when stored on your mobile device.
